2. — Collection and Storage of Personal Data, Manner and Purpose for which Data is Used

a) Visitors to the website:
When our website www.kcnb.de is accessed, the browser used on your device automatically transmits information to the server of our website. This information is temporarily stored in a so-called logfile. The following information is collected without interaction on your part and stored until it is automatically erased:

  • IP address of the computer sending the request,
  • date and time at which access was sought,
  • name and URL of the data file retrieved,
  • website from which access was obtained (referrer URL),
  • browser used and possibly the operating system of your computer as well as the name of your access provider.

The above-mentioned data is processed by us for the following purposes:

  • in order to ensure establishment of a smooth connection with the website,
  • in order to ensure comfortable use of our website, and
  • for the purpose of analyzing the security and stability of the system.

The legal basis for the data-processing is Art. 6(1)(f) of the EU General Data Protection Regulation. Our legitimate interest arises from the above-mentioned purposes for which data may be collected. On no account will we use the collected data for the purpose of drawing conclusions as to your identity.


b) Use of our registration form for events
You can register for our events by using the registration form on our website. If you register accordingly, we will obtain your full name, your e-mail address and the number of participants you register for the event, and will process this personal data in order to prepare and conduct our event.

The processing of data for the purpose of registration for one of our events takes place according to Art. 6(1)(a) of the EU General Data Protection Regulation on the basis of the consent you grant voluntarily.

The personal data we collect in this connection will be erased after the relevant event has taken place.


c) Use of our e-mail addresses in order to establish contact
Should you have any questions, you can contact us using the e-mail addresses listed on the website, especially mail@kcnb.de. If you contact us, we will process the personal data you provide, especially your e-mail address, for the purpose of responding to your query. All information contained in your e-mail is provided voluntarily.

The processing of data for the purpose of establishing contact with us takes place according to Art. 6(1)(a) of the EU General Data Protection Regulation on the basis of the consent you grant voluntarily.

The personal data we collect in this connection will be erased after the query you submitted has been dealt with.


d) Applications
We collect, process and use the data you provide to us within the context of your application for the purpose of processing your application and conducting the application procedure. In doing so we only collect data that is required. All data is of course treated confidentially.

If your application is unsuccessful, your data will be stored for a period of six (6) months and then erased. If the application procedure is completed successfully, we will transfer your data into your personnel file.

This data-processing takes place on the basis of Art. 6(1)(b) EU General Data Protection Regulation.


e) Client relationships
If you instruct us to advise on a legal matter, we collect information such as your title, your first name and surname, contact data (address, telephone number, e-mail address) as well as information required within the context of the client relationship in order to assert or defend your rights.

This data is collected for the purpose of conducting and handling the client relationship, especially in order to be able to identify you as our client, in order to provide appropriate legal advice and representation to you, in order to enter into correspondence with and submit invoices to you.

The data is processed owing to your query and the processing is necessary according to Art. 6(1)(b) of the EU General Data Protection Regulation (GDPR) for the relevant purposes in order to handle the client matter appropriately and for the fulfillment by both sides of obligations arising from the agreement on a client relationship and fees.

The personal data we collect for client relationship purposes will be stored until the statutory safe-keeping period for lawyers - 6 years after the calendar year ends in which the client relationship was terminated - and will subsequently be erased unless we are obliged to store it for a longer period in accordance with Art. 6(1)(c) GDPR owing to safe-keeping and documentation obligations under tax law and commercial law (German Commercial Code (HGB), German Criminal Code (StGB), German Fiscal Code (AO), etc.), or if you have consented to a longer storage period in accordance with Art. 6(1)(a) GDPR .


f) Google Maps
This website uses the map service Google Maps via a link. Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”).

Through a click on the link on our website, Google receives the information that you have accessed the relevant link on our website and also receives the information mentioned in a) above. If you are logged-in at Google, your data will be directly attributed to your account. If you do not want your data to be attributed to your profile at Google, you have to log out before using the service.

Google Maps is used in the interest of making our premises easier to find. This constitutes a legitimate interest in the sense of Art. 6(1)(f) EU General Data Protection Regulation dar. g) Google Analytics
Insofar as you have granted your consent, the web analysis service Google Analytics is used on our website. The provider is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). Use also includes the operation of Universal Analytics. This enables data, sessions and interactions involving several devices to be attributed to a pseudonymous user-ID and thus enables the activities of a user on several devices to be analyzed.

Google Analytics uses so-called “cookies”, text files stored on your computer which enable your use of the website to be analyzed. The information generated by the cookie regarding your use of this website is generally communicated to and stored on a Google server in the USA. If IP anonymization is activated on this website, however, within the EU Member States and in other EEA Contracting States your IP address is abbreviated by Google before being transmitted. In exceptional cases only the full IP address is communicated to a Google server in the USA and abbreviated there. This website uses Google Analytics with the add-on “_anonymizeIp( )”. This means that IP addresses are processed in abbreviated form, thus excluding direct attribution to a specific person. Insofar as the data obtained about you can be attributed to you, this attribution is immediately excluded and the personal data thus promptly erased. Google will use the information on our behalf in order to analyze your use of the website, to compile reports about website activities and to provide further services to us relating to use of the website and internet use.

The IP address communicated by your browser within the context of Google Analytics is not combined with other data by Google.

The legal basis for the use of Google Analytics is your consent according to Art. 6(1)(a) EU General Data Protection Regulation.

You can revoke your consent at any time with future effect by preventing the storage of cookies through a corresponding setting in your browser software; however, it is important to note that if you do so you might be unable to use all functions of this website. 3. — Communication of Data

There is no transmission of your personal data to third parties for purposes other than those mentioned in this Data Privacy Policy and those mentioned below. We only communicate your data to third parties:

  • if you expressly grant your consent to such communication according to Art. 6(1)(a) EU General Data Protection Regulation;
  • if communication of the data is lawful and necessary according to Art. 6(1)(b) EU General Data Protection Regulation in order to conduct the client relationship with you. This includes, in particular, communication to opponents in proceedings and their representatives (especially their legal counsel) as well as to courts and other public authorities for the purpose of correspondence and for the establishment and defence of your rights. The data communicated may be used by the third party solely for the purposes mentioned. The attorney-client privilege remains unaffected. Insofar as the data falls under the attorney-client privilege, it will be communicated to third parties only after you have been consulted;
  • if there is a statutory obligation to communicate data according to Art. 6(1)(c) EU General Data Protection Regulation, and
  • if the communication of data is necessary according to Art. 6(1)(f) EU General Data Protection Regulation for the establishment, exercise or defence of legal claims and if there is no reason to assume that you have a conflicting, overriding interest requiring protection of your data.

4. — Rights of Data Subject

You are entitled to

  • require information about the personal data about you that we process;
  • require the prompt correction of inaccurate or completion of the personal data about you that is stored by us;
  • require the erasure of your personal data that is stored by us unless the processing is necessary in order to exercise the right of freedom of expression and information, to fulfil a legal obligation, for reasons of the public interest or in order to establish, exercise or defend legal claims;
  • require that the processing of your personal data be restricted insofar as you contest the accuracy of the data, insofar as the processing is unlawful yet you oppose the erasure of the data, if we no longer require the data yet you need it in order to establish, exercise or defend legal claims, or if you have objected to the processing;
  • receive the personal data about you that you made available to us, in a structured, commonly used and machine-readable format, or to require that it be transmitted to another controller;
  • revoke consent once granted to us at any time; this merely requires a corresponding e-mail to mail@kcnb.de, or
  • submit a complaint to a supervisory authority.

5. — Right to Object

Insofar as your personal data is processed on the basis of legitimate interests according to Art. 6(1)(f) EU General Data Protection Regulation , you are entitled to object to such processing on grounds relating to your particular situation or if your objection concerns processing for direct advertising purposes. If you wish to exercise your right to object, simply send a corresponding e-mail to mail@kcnb.de.


6. — Data Safety

We take appropriate technical and organizational safety measures in order to protect your data against accidental or intentional manipulation, partial or complete loss or destruction, and against unauthorized access by third parties. Our safety measures are improved continually in accordance with technological developments.


7. — Up-to-Date Status of and Amendments to this Data Privacy Policy

This Data Privacy Policy is currently valid in the version as at February 2021.
